Sophie Sparks Education Terms and Conditions for Parents 

These terms of use govern your engagement with Sophie Sparks Education services. By being on the Sophie Sparks Education platform, you agree to these terms of use in full. Sophie Sparks Education may amend these terms from time to time. Amendments will be effective upon notifying clients via the website, email, or SMS.

Agreement and Key Details

Sophie Sparks Education will provide clients with its unique educational services under the terms and conditions of this agreement.

Services

  1. Tutoring Services: Sophie Sparks Education provides clients with access to qualified tutors via the booking platform.
  2. Booking Tutors: Clients can book tutors for long-term or short-term periods with advance or short notice.
  3. User Management: Sophie Sparks Education may add additional users at its discretion. Clients are responsible for updating or removing users on their accounts.
  4. Tutor Verification: Sophie Sparks Education ensures that all tutors hold a current Working With Children Number (WWCN) prior to being available for booking.
  5. Qualifications: Sophie Sparks Education verifies all tutor qualifications to match their respective levels.
  6. Tutor Pool: Clients will have access to a pool of qualified tutors through Sophie Sparks Education services.
  7. Payments: Sophie Sparks Education manages all tutor payments through the platform.
  8. Booking Time: Tutors are booked in multiples of one-hour blocks.
  9. Insurance: Tutors are responsible for maintaining their own public liability insurance.

Duration

This agreement commences on the date of signing and will continue for 12 months, automatically renewing annually unless otherwise notified.

Fees and Payment Terms

  1. Tutor Levels and Rates: Tutors are paid based on their qualifications and experience.
  2. Fee Adjustments: Sophie Sparks Education reserves the right to amend fees with prior notice through the website, email, or SMS.

Cancellation Policy

Sophie Sparks Education requires 24 hours’ notice to cancel any booking. Failure to do so will result in the full booking fee being charged.

Intellectual Property

  1. All intellectual property rights, including software, website, and systems, are and remain the property of Sophie Sparks Education.
  2. Clients must not make private arrangements or bookings with any tutors affiliated with Sophie Sparks Education. Breaching this agreement may result in a $2,000 fine and reportable conduct under NSW Fair Trading. A six-month cooling-off period is required before engaging in financial dealings with previous tutors, clients, or students of Sophie Sparks Education.

Requirements

To use Sophie Sparks Education services, you must:

  1. Be at least 18 years of age.
  2. Provide accurate personal information, including your name, address, mobile number, and valid payment method.
  3. Ensure a safe and appropriate workspace for tutors, such as an open space or a room with an open door visible to the client.

Restrictions

  1. All communications and information between tutors, students, parents, and Sophie Sparks Education are strictly confidential.
  2. Clients must avoid social interactions with tutors, including interactions on social media.

Limitations and Exclusions of Liability

To the fullest extent permitted by law, Sophie Sparks Education and its affiliates are not liable for any loss or damage arising from:

  • Use of or inability to use the services.
  • Interruptions, suspensions, or terminations of the service.
  • Loss or corruption of data, databases, or software.

Indemnity

You indemnify Sophie Sparks Education against any losses, damages, or legal expenses resulting from your breach of these terms.
