Sophie Sparks Education Terms and Conditions for Tutors

These terms of use govern your engagement with Sophie Sparks Education services. By working with Sophie Sparks Education, you agree to these terms of use in full. Sophie Sparks Education may amend these terms from time to time. Amendments will be effective upon notifying tutors via the website, email, or SMS.

Requirements

To work with Sophie Sparks Education, you must:

  1. Age Requirement: Be at least 18 years of age. By agreeing to these terms, you warrant and represent that you meet this age requirement.
  2. Personal Information: Provide your name, address, date of birth, mobile phone number, and a valid payment method. You must maintain accurate, complete, and up-to-date information with Sophie Sparks Education. Failure to do so may result in your inability to access services.
  3. Working With Children Check (WWCC): Hold a current WWCC in accordance with the NSW Office of the Children’s Guardian under Part 2, Section 6 of the Child Protection (Working with Children) Act 2012.
  4. Qualifications: Provide your qualifications and educational certificates applicable to your tutoring role.
  5. Contract and Code of Conduct: Read, sign, and abide by the Sophie Sparks Education Contract and Code of Conduct at all times.
  6. ABN and Tax Obligations: Hold an Australian Business Number (ABN) and be responsible for your own tax payments and private indemnity insurance.

Restrictions

  1. Confidentiality: All information shared between tutors, students, parents, and Sophie Sparks Education is strictly confidential.
  2. Social Media and Interactions: Tutors must not engage in social interactions with students, including on social media platforms.
  3. Private Arrangements: Tutors found engaging in private arrangements with Sophie Sparks Education clients will incur a $2,000 fine. This will be reportable conduct under NSW Fair Trading. A six-month cooling-off period must be observed before any financial dealings with former clients, students, or parents.
  4. Third-Party Involvement: Tutors must not involve third-party individuals to conduct lessons on their behalf.
  5. Cancellations: Tutors must cancel any lesson at least 12 hours in advance failure to do this will result in a missed tutorial fine of $50. In emergencies, cancellations must be made via both email and direct contact with Sophie Sparks Education.

Limitations and Exclusions of Liability

To the fullest extent permitted by law, Sophie Sparks Education and its affiliates are not liable for any loss or damage arising from:

  • The use of or inability to use services.
  • Interruptions, suspensions, or terminations of services.
  • Loss or corruption of data, databases, or software.

Sophie Sparks Education shall not be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages related to its services.

Indemnity

You agree to indemnify and keep Sophie Sparks Education indemnified against any losses, damages, costs, liabilities, or expenses (including legal expenses) arising from:

  • Breach of these terms.
  • Claims alleging you have breached these terms.
