These terms of use govern your engagement with Sophie Sparks Education services. By being on the Sophie Sparks Education platform, you agree to these terms of use in full. Sophie Sparks Education may amend these terms from time to time. Amendments will be effective upon notifying clients via the website, email, or SMS.
Agreement and Key Details
Sophie Sparks Education will provide clients with its unique educational services under the terms and conditions of this agreement.
Services
- Tutoring Services: Sophie Sparks Education provides clients with access to qualified tutors via the booking platform.
- Booking Tutors: Clients can book tutors for long-term or short-term periods with advance or short notice.
- User Management: Sophie Sparks Education may add additional users at its discretion. Clients are responsible for updating or removing users on their accounts.
- Tutor Verification: Sophie Sparks Education ensures that all tutors hold a current Working With Children Number (WWCN) prior to being available for booking.
- Qualifications: Sophie Sparks Education verifies all tutor qualifications to match their respective levels.
- Tutor Pool: Clients will have access to a pool of qualified tutors through Sophie Sparks Education services.
- Payments: Sophie Sparks Education manages all tutor payments through the platform.
- Booking Time: Tutors are booked in multiples of one-hour blocks.
- Insurance: Tutors are responsible for maintaining their own public liability insurance.
Duration
This agreement commences on the date of signing and will continue for 12 months, automatically renewing annually unless otherwise notified.
Fees and Payment Terms
- Tutor Levels and Rates: Tutors are paid based on their qualifications and experience:
- Level 1 Tutor: University Student – $99 inc GST
- Level 2 Tutor: Fully Qualified NESA accreditedTeacher some teachers have HSC and/or IB experience $155
- Fee Adjustments: Sophie Sparks Education reserves the right to amend fees with prior notice through the website, email, or SMS.
Cancellation Policy
Sophie Sparks Education requires 24 hours’ notice to cancel any booking. Failure to do so will result in the full booking fee being charged.
Intellectual Property
- All intellectual property rights, including software, website, and systems, are and remain the property of Sophie Sparks Education.
- Clients must not make private arrangements or bookings with any tutors affiliated with Sophie Sparks Education. Breaching this agreement may result in a $2,000 fine and reportable conduct under NSW Fair Trading. A six-month cooling-off period is required before engaging in financial dealings with previous tutors, clients, or students of Sophie Sparks Education.
Requirements
To use Sophie Sparks Education services, you must:
- Be at least 18 years of age.
- Provide accurate personal information, including your name, address, mobile number, and valid payment method.
- Ensure a safe and appropriate workspace for tutors, such as an open space or a room with an open door visible to the client.
Restrictions
- All communications and information between tutors, students, parents, and Sophie Sparks Education are strictly confidential.
- Clients must avoid social interactions with tutors, including interactions on social media.
Limitations and Exclusions of Liability
To the fullest extent permitted by law, Sophie Sparks Education and its affiliates are not liable for any loss or damage arising from:
- Use of or inability to use the services.
- Interruptions, suspensions, or terminations of the service.
- Loss or corruption of data, databases, or software.
Indemnity
You indemnify Sophie Sparks Education against any losses, damages, or legal expenses resulting from your breach of these terms.

Sophie Sparks Education Terms and Conditions for Tutors
These terms of use govern your engagement with Sophie Sparks Education services. By working with Sophie Sparks Education, you agree to these terms of use in full. Sophie Sparks Education may amend these terms from time to time. Amendments will be effective upon notifying tutors via the website, email, or SMS.
Requirements
To work with Sophie Sparks Education, you must:
- Age Requirement: Be at least 18 years of age. By agreeing to these terms, you warrant and represent that you meet this age requirement.
- Personal Information: Provide your name, address, date of birth, mobile phone number, and a valid payment method. You must maintain accurate, complete, and up-to-date information with Sophie Sparks Education. Failure to do so may result in your inability to access services.
- Working With Children Check (WWCC): Hold a current WWCC in accordance with the NSW Office of the Children’s Guardian under Part 2, Section 6 of the Child Protection (Working with Children) Act 2012.
- Qualifications: Provide your qualifications and educational certificates applicable to your tutoring role.
- Contract and Code of Conduct: Read, sign, and abide by the Sophie Sparks Education Contract and Code of Conduct at all times.
- ABN and Tax Obligations: Hold an Australian Business Number (ABN) and be responsible for your own tax payments and private indemnity insurance.
Restrictions
- Confidentiality: All information shared between tutors, students, parents, and Sophie Sparks Education is strictly confidential.
- Social Media and Interactions: Tutors must not engage in social interactions with students, including on social media platforms.
- Private Arrangements: Tutors found engaging in private arrangements with Sophie Sparks Education clients will incur a $2,000 fine. This will be reportable conduct under NSW Fair Trading. A six-month cooling-off period must be observed before any financial dealings with former clients, students, or parents.
- Third-Party Involvement: Tutors must not involve third-party individuals to conduct lessons on their behalf.
- Cancellations: Tutors must cancel any lesson at least 12 hours in advance failure to do this will result in a missed tutorial fine of $50. In emergencies, cancellations must be made via both email and direct contact with Sophie Sparks Education.
Limitations and Exclusions of Liability
To the fullest extent permitted by law, Sophie Sparks Education and its affiliates are not liable for any loss or damage arising from:
- The use of or inability to use services.
- Interruptions, suspensions, or terminations of services.
- Loss or corruption of data, databases, or software.
Sophie Sparks Education shall not be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages related to its services.
Indemnity
You agree to indemnify and keep Sophie Sparks Education indemnified against any losses, damages, costs, liabilities, or expenses (including legal expenses) arising from:
- Breach of these terms.
- Claims alleging you have breached these terms.
